Why Hire a process server?

​Collection agencies and legal corporations from all corners of the world often use process servers.  They use them for different legal actions that are easier to delegate to others, rather than using their own resources to do them.  These include serving of legal documents, filing of legal documents with the courts, skip tracing, and many other tasks.
 
At one time law enforcement agencies used to handle this kind of activity.  However, this was a strain on their resources and because of this, Process Serving became a new profession.  There are many agencies around the world that perform this service today.

Who is a Process Server?
A process server takes on the responsibility of serving legal documents on defendants or respondents involved in different legal or court cases.  Documents include such legal forms as divorce papers, restraining orders, summons to appear, subpoenas, and other legal documents.  They have 2 means of carrying out this process.  They can be done by personal service, where the court document is physically served upon an individual directly.  This is actually an option that any individual can do, ensuring that legal procedure is followed.  Or, alternatively, they can be done by ordinary service, which includes mailing, faxing, or emailing the documents.  We would urge any one who is planning on doing the document service themselves, reach out for advice first, as there are regulations that need to be strictly followed.  A Process Server will also perform document recovery and court filing.

Affidavit of Service
Process Servers are required to provide a notarized proof of service or affidavit of service.  This is legal evidence that the documents have been served on the individual or company as per legal requirements.  Depending on the province of the service, the Process Server must adhere to the provincial and federal regulations regarding the service.  And the regulations may vary from province to province.  It is the responsibility of the Process Server to be aware of what is required.

 The Responsibility of a Process Server
Serving of legal documents may sound like a simple job but there is much about this that is not simple.  Legal court documents must be served correctly according to the provincial and federal requirements.  Failure to follow these procedures can have significant effect on legal actions before our courts.  Therefore, a Process Server must be responsible, efficient, and knowledgeable about legal implications of the task they perform.  Lawyers, Court Representatives, Investigative Firms, and individuals use Process Servers to perform this task because of the level of expertise they provide.

Benefits of Hiring a Process Server
Besides the very fact that Process Servers are experience, knowledgeable, trustworthy, and experts in their field, there are some basic benefits of using their services.

Thirdly, the Process Server has a clear understanding of the various regulations that pertain to each province and the federal law.  They know exactly what is permissible and what is not permissible according to the law.  And will share this information with clients.  So that nothing is done beyond the scope of the law.

 Fourthly, Process Servers are skilled and efficient at locating individuals who may be dodging their legal obligations or court summons. They have different tools and means at their disposal to locate parties.  Many also have Private Investigator licenses and are under oath to treat people equitably and without bias.

And lastly, they are neutral third parties.  They are not involved in any case or dispute and are completely neutral while carrying out their service.  They treat the defendant or respondent with respect to the person and the person’s privacy.  They ensure all tasks are completed correctly and efficiently, while also using tact when dealing with individuals.
